Disputes related to these Terms of Service are governed by Ontario law, and the exclusive jurisdiction is in the Courts of British Columbia.
Dispute Resolution:
Any disputes will be resolved through arbitration in Vancouver, British Columbia, in compliance with the British Columbia Arbitration Act.
Waiver of Class Actions:
All disputes must involve individually named parties, waiving the right to class actions.
Waiver:
Failure to enforce a provision does not waive the right to enforce it later. If a provision is unenforceable, it will be limited or eliminated, and the rest of the Terms of Service will remain valid.
Force Majeure:
Non-performance due to causes beyond reasonable control, excluding timely payment, is excused.
